U.S. Senators Todd Young (R-Ind.) and Shelley Moore Capito (R-W. Va.), along with a bipartisan group of Senate colleagues, have introduced a Congressional Review Act (CRA) joint resolution of disapproval to formally challenge the Biden Administration’s regulations aimed at shutting down American power plants.

The CRA follows the Environmental Protection Agency's (EPA) issuance of final rules that impose stringent emissions requirements on existing coal-fired power plants and newly constructed gas-fired power plants. This move, which seeks to close power plants supplying America’s baseload electricity, was previously attempted under President Obama and overturned by the Supreme Court in West Virginia v. EPA.

“The Biden Administration’s Clean Power Plan 2.0 will hurt Hoosier families and our nation’s energy infrastructure and security,” said Senator Young. “I strongly oppose this unnecessary bureaucratic overreach.”

“With this Congressional Review Act resolution of disapproval, every member of Congress will have the opportunity to protect America’s energy future, heed the warnings of our nation’s electric grid operators, and adhere to the precedent set by the Supreme Court," stated Senator Capito. "This vote is an important one because the Biden administration’s Clean Power Plan 2.0 makes it clear it will stand with climate activists, regardless of the harm that is sure to be done to families, workers, and communities across West Virginia and the rest of the country."

Senator Capito expressed appreciation for her Senate and House colleagues joining this bipartisan effort to reject what she termed as another unrealistic regulation.

U.S Representative Troy Balderson led 138 of his colleagues in introducing an identical resolution in the House of Representatives.
